A 22-year-old woman named Caylin Tucker claims she had a severe allergic reaction after eating at a Cheesecake Factory in the Houston area. She alleges that she informed her server of her severe peanut allergy before ordering and was assured that her meal would be prepared without peanuts. However, Tucker says the dish she received was covered in peanut sauce, which led to an immediate anaphylactic reaction. Anaphylaxis is a life-threatening allergic response that can cause symptoms like swelling, difficulty breathing, hives, and can be fatal if not treated quickly. Tucker reportedly experienced swelling of her tongue and lips, followed by throat closure and hives, and required emergency medical care. She claims the incident caused her physical pain, emotional distress, and significant medical expenses. The lawsuit filed in Harris County District Court on September 11 alleges that the Cheesecake Factory and its staff failed to ensure the meal was free of peanuts. It claims the restaurant breached its duty to exercise ordinary care in food preparation and service and did not follow proper allergen safety protocols. The complaint also states that the restaurant did not adequately train employees to document allergies or check food before serving. However, the lawsuit does not specify which dish was ordered, whether the peanut sauce was visible before eating, or if Tucker had an EpiPen with her or was taken to the hospital. Tucker’s attorney did not respond to requests for further details. Cheesecake Factory has not responded to requests for comment on this case. The restaurant chain has faced previous food safety concerns. In 2013, a man was awarded $14,000 after contracting scombroid poisoning from a Cheesecake Factory in Wisconsin. In 2014, an incident involving Salmonella from tainted whipped cream occurred in Idaho. More recently, diners have reported finding foreign objects in their meals at multiple locations. These past incidents suggest a pattern of food safety concerns that the company has faced over the years. Tucker’s case highlights the importance of food allergy awareness and the need for strict protocols in restaurants to prevent such incidents. While the restaurant has not commented on this specific case, it remains to be seen how the legal process will unfold and whether it will lead to changes in how the chain handles food allergies.
