Terms of use

1. Purpose

These terms of use (the "Terms") govern access to and use of the Newtrly service, available at newtrly.com and through the Newtrly mobile applications (the "Service").

The Service is published by Maxime BELLOU, whose details appear in the legal notice (the "Publisher").

2. Acceptance

Using the Service constitutes full acceptance of these Terms. Creating an account requires express acceptance. If you do not accept these Terms, you must not use the Service.

3. Description of the Service

Newtrly aggregates news articles published by third-party sources and produces, through automated processing based on language models, neutral-language rewrites and summaries at three reading levels (Discovery, Standard, Expert), translated into French and English.

The Service is strictly a reading service. It has no comment sections, no messaging, and no user-published content.

Notice on automatically generated content. The texts published on Newtrly are produced by automated systems from third-party articles. Despite the care taken in their design, they may contain errors, omissions, approximations or misinterpretations. They constitute neither verified information of any official standing nor advice of any kind. Only the original articles, accessible from every story, are authoritative. Users should refer to them before making any decision.

4. Access and accounts

The Service can be read without an account. Creating an account gives access to personalised features (custom feeds, the "For you" feed, reading preferences).

  • Minimum age. Account creation is restricted to persons aged 15 or over. By creating an account you represent that you meet this condition.
  • Accuracy. You undertake to provide accurate information at registration and to keep it up to date.
  • Security. You are responsible for keeping your credentials confidential and for all activity carried out from your account. Report any unauthorised use to contact@newtrly.com without delay.
  • Deletion. You may delete your account at any time from your account page. Deletion erases the associated data under the conditions described in the privacy policy.

5. Pricing

The Service is currently provided free of charge. The Publisher reserves the right to introduce paid subscription plans. Should it do so, those plans will be governed by separate terms of sale, brought to your attention and subject to your acceptance before any subscription. No feature you currently enjoy free of charge will become chargeable without prior notice to you.

6. Permitted use

You undertake to use the Service for its intended purpose — individual consultation of news information — and in accordance with applicable law.

The following are prohibited in particular:

  • extraction, automated collection (scraping), systematic indexing or reproduction of a qualitatively or quantitatively substantial part of the Service's content;
  • reuse of the Service's content for commercial purposes, or its incorporation into another product or service, without prior written authorisation;
  • use of the Service's content to train, fine-tune or evaluate artificial-intelligence models;
  • any attempt to circumvent technical protection measures, access limitations or authentication mechanisms;
  • any action liable to disrupt, overload or compromise the operation or security of the Service;
  • the use of automated means of access (bots, agents) otherwise than in accordance with the rules published in the site's robots.txt file.

7. Intellectual property

The Service, its interface, its visual identity, its databases and its source code are the property of the Publisher and are protected as such.

The original articles aggregated by the Service remain the property of their respective publishers. The neighbouring rights of press publishers and news agencies are reserved.

Nothing in these Terms shall be construed as granting the user any intellectual property right over the Service or the content published on it.

8. Reporting and removal

Any request to correct or remove content — whether from a rights holder, a data subject, or any user who identifies unlawful or inaccurate content — should be sent to contact@newtrly.com, following the procedure set out in the legal notice. The Publisher will respond as soon as possible and will remove manifestly unlawful content without delay.

9. Availability and changes to the Service

The Service is provided "as is" and as available. The Publisher does not warrant uninterrupted or error-free operation. It may at any time modify, suspend or discontinue all or part of the Service, in particular for maintenance, security or technical reasons, without this giving rise to any compensation.

10. Liability

The Publisher is bound by an obligation of means in providing the Service.

It shall not be held liable for:

  • errors, inaccuracies or omissions in automatically generated content, nor for decisions taken on the basis of that content — users being invited to refer to the original articles;
  • the content of third-party sites reachable from links published on the Service, over which the Publisher exercises no control;
  • indirect damage, such as loss of data, revenue or opportunity, resulting from the use of or inability to use the Service;
  • unavailability attributable to force majeure, to the internet network or to a third-party provider.

Nothing in these Terms limits the Publisher's liability in the event of gross negligence or wilful misconduct, personal injury, or where the law prohibits such limitation.

11. Suspension

In the event of an established breach of these Terms, in particular of clause 6, the Publisher may suspend or terminate access to the Service, where circumstances permit after informing the user.

12. Personal data

The processing of your personal data is described in the privacy policy, which forms an integral part of these Terms.

13. Changes to the Terms

The Publisher may amend these Terms. The applicable version is the one published on this page, whose version number and update date are shown at the top. In the event of a substantial change, account holders will be informed and their acceptance may be required again.

14. Governing law and dispute resolution

These Terms are governed by French law.

In the event of a dispute, users are invited to contact the Publisher at contact@newtrly.com in order to seek an amicable solution.

Under articles L.611-1 et seq. of the French Consumer Code, any consumer may refer a dispute free of charge to a consumer mediator with a view to an amicable settlement. The European Commission also provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr

Failing an amicable settlement, the dispute shall be brought before the competent French courts.
