A Moroccan national who previously held a "seasonal worker" residence permit in France has been granted a temporary "employee" status by the Nièvre prefecture. This decision was based on **Article L435-4** of the Code of Entry and Stay of Foreigners and Asylum, which allows for the exceptional issuance of a one-year "employee" or "temporary worker" card under specific conditions. The individual had worked for at least twelve months in a profession marked by recruitment difficulties, specifically bricklaying, in the Nièvre region. They also had continuous residence in France for more than three years, showed integration into French society, and had no history of public order disturbances. The "seasonal worker" status, governed by **Article L421-34** of the Code of Entry and Stay of Foreigners and Asylum, allows individuals to stay in France for up to six months per year and is valid for a maximum of three years. However, this status does not automatically convert to an "employee" card when a person signs a permanent employment contract. A separate application is required for a change in status. **Article L435-4**, introduced by **Article 27** of the law of January 26, 2024, allows prefects to issue temporary "employee" or "temporary worker" cards under specific conditions. These include having worked for at least twelve months in a profession and region facing labor shortages, having lived in France continuously for at least three years, and demonstrating social and family integration. However, the article also excludes periods of stay and professional activity under the "seasonal worker" title from these counts, and this exclusion remains in place until December 31, 2026. The Franco-Moroccan agreement of October 9, 1987, gives prefects discretion in regularizing Moroccan nationals, as confirmed by the Council of State in a 2014 decision. Additionally, an interministerial instruction from February 5, 2024, allows Moroccan and Tunisian nationals to apply for an "employee" or "temporary worker" card under a prefect's discretionary power. However, these provisions do not override the exclusion of seasonal periods from eligibility calculations. Bricklayers are listed as a tense profession in the Centre-Val de Loire and Bourgogne-Franche-Comté regions under code B2Z40, according to Annex I of the decree of May 21, 2025. To support a status change request, individuals must provide documents such as employment contracts, pay slips, professional certificates, proof of salary payments, and evidence of residence and integration. The Nièvre prefecture’s decision shows that a former "seasonal worker" can transition to an "employee" status under certain conditions. It highlights that durable employment in a profession facing labor shortages, combined with integration into French society, may warrant individual assessment by prefects.
