She noted that while an arrest does not automatically disqualify someone from jury duty, the details of the juror’s questionnaire are sealed as part of the court record. "It's unlikely we will find out whether the juror made misrepresentations unless there is an official court-sanctioned inquiry," she added.
Polisi also addressed the potential impact of this revelation on the trial. "Typically this could be a reason to undermine a guilty verdict, but because in this case a mistrial has already been declared, it's unclear how this will affect the case moving forward," she said.
Clancy admitted to killing her three children, but the jury could not reach a consensus on whether she should be held criminally responsible. Some jurors and the defense attorney suggested the jury was split 11 to 1 in favor of finding her not criminally responsible due to evidence of her mental illness. On September 4, Judge William Sullivan declared a mistrial after the jury deadlocked three times. District Attorney Timothy Cruz has not yet decided whether to retry Clancy.
