Man faces new charges

A 26-year-old man, previously sentenced in 2023 to six months in prison with probation for assaulting his younger sister, was brought before the court in an immediate hearing on Thursday to answer charges of two new sexual offenses committed against the same victim.

Charges of incestuous assault

He was sentenced to five years in prison. The man, described as a bricklayer, appeared before the court to answer charges of two incestuous sexual assaults committed against his younger sister.

Alleged acts and victim’s account

It was alleged that he had forced digital penetration on her while she was asleep in August 2025 and September 2026. The victim was reportedly rejected by her family, who did not believe her, and had to seek refuge with her uncle.

Legal recidivism and the accused’s stance

The young man was judged to be in a state of legal recidivism and explained that he did not know if he had committed the acts while refusing to accuse his sister of lying. A position difficult to understand for an accused described as having almost no sexual life.

Accused’s request and victim’s condition

The man asked the court to place him in prison because the Nuutania prison was not "friendly" and assured that he felt compassion for his sister's "suffering." Although the victim refused to speak during the hearing, the court president explained that she suffered from sleep disorders, anxiety, had self-harmed, and felt a great sense of guilt despite her status as a victim.

Lawyer condemns behavior

Her lawyer, Me Christophe Rousseau-Wiart, condemned the accused's behavior, who should have been a protective older brother and not a sexual offender. He also indicated that his client had accepted the classification of the rapes as lesser offenses to avoid a heavy criminal trial, even though the acts "could have been tried" before the criminal court.

Double harm and legal failure

The lawyer also emphasized the double harm suffered by the young woman, who was assaulted and then "abandoned" by her parents. A "heavy sentence" was requested by the representative of the public ministry, who condemned during her arguments a certain slowness in the procedure and the fact that the young woman's parents had "failed in their protective mission."

Defending the accused

Confronted with the contradictory attitude of the accused, the lawyer for the accused, Me Chloé Atlan, began her plea by explaining that he was particularly "stressed" and that he was "speaking poorly." Without any intention to "contest the facts," she nevertheless assumed that the victim had experienced memories of her first assault.

Sentence imposed

She also raised the fact that medical examinations had not revealed any injuries. The man was finally sentenced to five years in prison with the revocation of the six months of probation to which he had been previously sentenced.
