The European Commission has classified ChatGPT, Reddit, and Roblox as high-impact digital services under the Digital Services Act (DSA), an EU law that took effect in 2022. These services have confirmed they reach at least 45 million monthly active users in the European Union on average, meeting the criteria for being labeled as "very large online platforms" (VLOP) or "very large online search engines" (VLOSE). This designation brings additional regulatory responsibilities, including the need to evaluate and mitigate systemic risks from their services, such as the spread of illegal content, effects on minors, and impacts on public safety and fundamental rights.
The DSA replaces and expands upon an older EU law from 2000, creating a more detailed framework for how digital services handle user content, manage risks, and maintain transparency. It applies to a wide range of online services, including social networks, marketplaces, app stores, and search engines. The law introduces a tiered system of rules, with basic requirements for all services, more rigorous standards for online platforms, and the strictest rules for VLOPs and VLOSEs. These top-tier services must now comply with new obligations by January 2027, ensuring they operate responsibly and transparently.
ChatGPT is an AI system that can answer questions, generate text, and perform web searches, making it a hybrid service that falls under the search engine category. Reddit is a social platform where users share and discuss content in specialized communities, while Roblox is a game creation and sharing platform that allows users to design and play interactive experiences. All three services are considered online platforms under the DSA because they enable users to share content with the public. As a result, they are now subject to closer scrutiny by EU regulators.
The European Commission will work with national digital services coordinators to monitor compliance with the DSA. For example, Ireland’s Coimisiún na Meán will oversee ChatGPT and Reddit, while the Netherlands’ Authority for Consumers and Markets (ACM) will handle Roblox. Henna Virkkunen, the EU’s Executive Vice President for technology, security, and democracy, emphasized that these designations reflect the need for stronger oversight of services that have a major influence on society. She stated that the EU will continue to monitor the digital landscape and apply the DSA to any service that meets the threshold for increased regulation.
Currently, 28 services have been designated as VLOPs or VLOSEs under the DSA, with oversight shared between the European Commission and national authorities. This approach ensures that the regulation is both effective and adaptable to the diverse digital environment across the EU.
