Property developer St James Group Ltd and specialist contractor Lindner Prater have been fined a total of £1.3 million after a man was killed by a falling window at a luxury apartment complex in London. The incident occurred in October 2018 when 53-year-old coach driver Mick Ferris was crushed by a 130kg window pane that fell from the 26th floor of The Corniche development in Vauxhall. The window fell approximately 300 feet, striking Mr. Ferris and killing him instantly. The Inner London Crown Court found both companies guilty of failing to conduct proper risk assessments and ignoring foreseeable dangers. This failure was particularly concerning given that a similar window had fallen from the same building in August 2017. The court ordered St James Group Ltd to pay £1 million and Lindner Prater £300,000 in fines, along with additional costs of £125,000 each. However, the court cleared architecture firm Foster + Partners and engineering consultants Wintech Ltd of any safety violations related to the incident. Mick Ferris’s widow, Rachel Ferris, expressed her anguish during the trial, stating that the tragedy was entirely preventable. She emphasized that the falling window could have injured or killed anyone in the vicinity, highlighting the serious nature of the companies’ negligence. Her comments underscore the importance of rigorous safety protocols in construction and maintenance, especially in high-rise buildings. The case has drawn attention to the need for stricter oversight and accountability in the construction industry. It serves as a reminder that even small oversights in risk management can lead to catastrophic consequences. The fines and legal action taken against St James Group Ltd and Lindner Prater reflect the severity of their failures and the legal repercussions of neglecting safety standards.
