Fireworks and flammable items banned in Alpes-Maritimes

A prefectural decree has restricted the use of fireworks and the transport of flammable products on public roads in the Alpes-Maritimes department until November 1st at 11 PM. The restrictions apply to all areas of the department, including during Halloween celebrations.

Decree issued on October 26

The decree, numbered AP 2026-1708, was issued by Prefect Jean-Marie Girier on October 26 and published by the commune of Malaussene. It took effect at 6 PM on Monday and will remain in place until the deadline of November 1st at 11 PM.

Extension of previous restrictions

The measure builds on an earlier restriction introduced in Nice on October 19, which was later extended to the entire department for October 24 and 25. The prefecture cited incidents of violence and property damage at gatherings in Nice as a reason for the expansion of the restrictions.

Prohibited items include fireworks and flammable substances

The decree prohibits the possession, use, and transport of fireworks such as firecrackers, rockets, and mortars on public roads. This applies to all communes in the department, not just areas near gathering spots. It also covers items used for Halloween celebrations on October 31.

Transport of flammable products also restricted

The decree bans the transport of flammable substances like gasoline, oil, alcohol, and solvents in individual containers. This includes the movement of such products in cans by individuals, unless they are professionals using them for their work.

Restrictions on weapons and protective gear

The text also prohibits carrying weapons or objects that could be classified as weapons under the penal code without a legitimate reason. It targets protective equipment designed to counter law enforcement tools used for public order, rather than general clothing or accessories.

Professional exceptions apply

Professionals are allowed to carry restricted items if necessary for their work. Private individuals and merchants must ensure that their activities fall within these exceptions and are not for personal use or preparation.

Reasons for expanding the restrictions

The prefecture cited the presence of people arrested after gatherings on October 17, 18, and 24 in several communes across the department, including Antibes, Cannes, and Grasse. Checks at train stations in Cannes and Saint-Laurent-du-Var prevented 120 people from attending the October 24 gathering with prohibited items.

Restrictions cover Halloween night

The deadline of November 1st at 11 PM includes the evening of October 31, when fireworks are typically used for Halloween. Residents planning festivities should be aware of the restriction when purchasing or transporting pyrotechnic items.

Violations may lead to legal consequences

The decree states that violations will be handled according to existing legal provisions, without specifying additional penalties. The restrictions remain in effect until the stated deadline of November 1st at 11 PM.
