Legal dispute over repair estimate

A motorist in Bordeaux, Mr. [L] [M] [U], faced a legal battle after a repair estimate of 703.27 euros from the Etablissements Pierre Bouteville garage escalated into a 30,400 euro parking fee claim. The dispute, which reached the Cour de cassation on October 1, 2026, highlights the complexities surrounding the principle of contradiction and the right of retention.

Initial court ruling in motorist’s favor

Mr. [L] [M] [U] initially sued the garage to compel repairs for 703.27 euros. A judgment by the Bordeaux judicial court on February 22, 2021, ruled in his favor. However, the garage appealed, and the Bordeaux appellate court, in a decision on December 7, 2023, overturned the judgment, dismissed the motorist's requests for repairs and damages, and instead ordered him to pay 30,400 euros in parking fees for the period from April 2, 2019, to July 1, 2023, with legal interest.

Legal basis for parking fees

The significant difference between the repair estimate and the parking fee is explained by legal precedents from the Cour de cassation, including decisions from April 5, 2005, October 8, 2009, and April 19, 2023. These rulings established that the storage of a vehicle at a garage is considered an accessory deposit under a business contract, presumed to be remunerative. Consequently, even without a specific parking contract, a garage can claim compensation for vehicle storage, with no legal ceiling on such fees.

Appeal based on legal principle

Mr. [L] [M] [U] appealed the appellate court's decision, citing the principle of contradiction under Article 16 of the civil procedure code. He argued that the appellate court violated this principle by basing its decision on the absence of documents mentioned in his annexed list without inviting the parties to explain. The Cour de cassation acknowledged this violation, noting that the appellate court failed to invite the parties to comment on the absence of documents in the file.

Decision to rejudge the case

The second civil chamber of the Cour de cassation annulled the appellate court's decision, except for the part dismissing Mr. [L] [M] [U]'s request for an expert opinion. The case was referred back to the Bordeaux appellate court with a different composition. The garage, Etablissements Pierre Bouteville, was ordered to pay Mr. [L] [M] [U] 3,000 euros under Article 700 of the civil procedure code. The 30,400 euro parking fee claim remains unresolved, pending rejudgment by the appellate court.
