Elon Musk's companies, X Corp and SpaceXAI, have asked a federal court in Texas to dismiss a lawsuit they previously filed against Apple. The court has accepted this request, but the reasons behind the dismissal are not yet known. It is also unclear whether the case was settled out of court. Engadget has reached out to Apple for more information and will update readers once a response is received. The original lawsuit, filed last year, claimed that Apple violated antitrust laws by integrating ChatGPT tools into its new Apple Intelligence feature. Musk's companies argued that Apple was locking out competitors by favoring OpenAI's technology, which prevents other innovators like X and SpaceXAI from competing effectively. The lawsuit also accused Apple and OpenAI of conspiring against SpaceXAI’s products, including the controversial Grok chatbot, which has previously made offensive remarks about historical figures. The complaint suggested that Apple's exclusive partnership with OpenAI was the reason it did not promote SpaceXAI’s apps, such as X and Grok, more prominently on the App Store. However, other competitors of OpenAI, such as DeepSeek and Perplexity, have had their apps reach the top of the App Store charts, even after Apple’s partnership with OpenAI. In a separate development, California Governor Gavin Newsom criticized SpaceXAI for allegedly creating and hosting platforms that enable the spread of nonconsensual sexually explicit AI deepfakes, including images that digitally undress children. Newsom called for an immediate investigation into the company and urged the state’s Attorney General to take action. This follows an ongoing investigation by California authorities into allegations that the Grok app was used to generate thousands of child sexual abuse material (CSAM) images and that it facilitates the large-scale production of deepfake intimate images used to harass women and girls online. Despite these legal and ethical concerns, the Grok app managed to reach the top of the App Store charts, raising questions about whether this success was due to market manipulation or other factors. The situation highlights the growing scrutiny surrounding AI technologies and their potential for misuse.
